Welcome to Nutrl, Inc. (“Nutrl,” “we,” “us,” or “our”), operator of the Nutrl platform (the “Platform” or “Service”), accessible at nutrl.com and any associated applications, tools, or services (collectively, the “Site”).

This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you visit the Site, register for an account, or use the Platform as a Member (publisher/affiliate), Advertiser (brand), or visitor. By accessing or using the Platform, you acknowledge that you have read, understood, and agree to the practices described in this Privacy Policy.

If you do not agree, you must not access or use the Platform or Site. This Privacy Policy is incorporated by reference into our Terms of Service.

Nutrl may modify this Privacy Policy at any time in its sole discretion, without providing any notice to you. We will post the revised Privacy Policy on the Site with an updated “Last Revised” date. Your continued use of the Platform after any changes constitutes your acceptance of the revised policy. It is your responsibility to review this Privacy Policy periodically.

1. Information We Collect

We collect information to operate, improve, and protect the Platform. The types of information we collect include:

  • Account and Contact Information (from Members and Advertisers): Name, email address, username, password, business name, address, phone number, tax ID, and payment/banking details (for commission payouts or billing).
  • Platform Usage and Tracking Data: IP address, device type, browser information, operating system, referring URLs, pages viewed, time spent on the Site, clickstream data, and transaction/referral data (e.g., clicks, conversions, sales generated through your Links).
  • Cookies and Similar Technologies: We use cookies, pixels, web beacons, and other tracking technologies to attribute referrals, measure campaign performance, prevent fraud, and personalize your experience. See Section 5 below for details.
  • Communications: Information you provide when contacting us (e.g., support inquiries, feedback) or when we communicate with you.
  • Other Information: Any content or data you upload or submit (e.g., promotional creatives, profile information).

We do not knowingly collect or retain detailed personally identifiable information (PII) about end consumers/referrals beyond what is necessary for tracking and attribution (e.g., anonymized or hashed data for fraud prevention and commission validation).

2. How We Use Your Information

We use the collected information for the following purposes:

  • To provide, maintain, and improve the Platform, including facilitating affiliate partnerships, tracking referrals, processing commissions, and enabling campaign management.
  • To administer your account, verify identity, process payments, and communicate with you about the Platform.
  • To detect, prevent, and address fraud, security issues, or violations of our Terms of Service.
  • To analyze usage trends, personalize content, and optimize performance for Members and Advertisers.
  • To comply with legal obligations, respond to lawful requests, and enforce our agreements.
  • To send you marketing communications (e.g., newsletters, product updates) if you have opted in; you may opt out at any time.

3. How We Share Your Information

We do not sell your personal information. We may share information in the following circumstances:

  • With Advertisers and Members: Limited performance and referral data (e.g., clicks, conversions) is shared between participating Members and Advertisers to validate commissions and manage Campaigns.
  • Service Providers: With trusted third-party vendors who perform services on our behalf (e.g., payment processors, hosting providers, analytics services, email services). These providers are contractually obligated to protect your data and use it only for the services they provide.
  • Legal and Compliance: When required by law, subpoena, court order, or government request; to protect our rights, property, or safety; or in connection with a merger, acquisition, or sale of assets.
  • With Your Consent: In any other manner with your explicit consent.

As a service provider/processor for our clients (Advertisers and Members), we process data according to their instructions and applicable laws, including the California Consumer Privacy Act (CCPA) and General Data Protection Regulation (GDPR) where applicable.

4. Cookies and Similar Tracking Technologies

We and our third-party partners use cookies and similar technologies for essential Platform functions (e.g., session management, fraud prevention), analytics (e.g., Google Analytics), and performance measurement.

You can manage cookie preferences through your browser settings. However, disabling certain cookies may limit your ability to use features of the Platform, including tracking and commission attribution. For more details, please review our Cookie Policy (if published separately) or contact us.

5. Data Security

We implement reasonable administrative, technical, and physical safeguards to protect your information from unauthorized access, use, or disclosure. However, no security system is infallible, and we cannot guarantee absolute security.

6. Data Retention

We retain your personal information only as long as necessary to fulfill the purposes outlined in this Privacy Policy, comply with legal obligations, resolve disputes, and enforce our agreements. When no longer needed, we securely delete or anonymize it.

7. Your Rights and Choices

  • Access, Correction, Deletion: You may request access to, correction of, or deletion of your personal information by contacting us at the address below. We will respond within applicable legal timeframes (e.g., 30–45 days under CCPA).
  • Opt-Out of Marketing: You may unsubscribe from promotional emails using the link in each email.
  • CCPA Rights (California residents): You have the right to know what personal information we collect, request deletion, and opt out of any “sale” of personal information (we do not sell personal information).
  • GDPR Rights (if applicable): You may have rights to access, rectification, erasure, restriction, portability, and objection. Contact us to exercise these rights.
  • Do Not Track: Our Site does not currently respond to “Do Not Track” signals from browsers.

We will verify your identity before fulfilling requests to protect your privacy.

8. Children’s Privacy

The Platform is not intended for children under 18 years of age. We do not knowingly collect personal information from children. If we become aware that we have collected data from a child under 18 without parental consent, we will take steps to delete it.

9. International Data Transfers

Nutrl is based in the United States. Your information may be transferred to and processed in the U.S. or other countries where our service providers operate. We use appropriate safeguards (such as standard contractual clauses) for transfers from jurisdictions that require them.

10. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. We will notify you of material changes by posting the new policy on the Site and updating the “Last Revised” date. Your continued use of the Platform after such changes constitutes acceptance of the updated policy.
